The Council of the European Union has independently adopted various and numerous sanctions against Iranian banks through separate resolutions. European Union sanctions are binding on all member states, and the lifting of these sanctions by the Council of the European Union is conducted through the approval of a proposal within this Council. Moreover, according to the substantive rules of international law, such as the principle of immunity of central banks, the Central Bank is free to conduct international banking transactions and operates independently from the government, and therefore, imposing sanctions against it is not permissible. This research examines the content of various legal opinions and decisions resulting from the sanctions on the Central Bank of the Islamic Republic of Iran. Initially, some of the most important regulations, decisions, and resolutions of the European Union Council, European Court of Justice rulings, and European countries' decisions, including the United Kingdom's resolutions related to the sanctions on the Central Bank of Iran, will be discussed. Subsequently, the opinions and decisions of the United States will be examined, with the first section focusing on related rulings and the second section on the executive orders of the President, Congressional legislation, and Treasury Department resolutions.</p> <p>پس از اعمال تحریم‌های شورای امنیت علیه ایران، کشورهای ایالات متحده آمریکا و برخی از سازمانها وکشورهای عضو اتحادیه اروپا تحریم‌های یک جانبه فراتر از قطعنامه تصویب شده توسظ شورای امنیت را نیز علیه ایران اعمال کردند. شورای وزیران اتحادیه اروپا تاکنون تحریم‌های متنوع و متعددی را علیه بانکهای ایران به صورت مصوبه‌های مستقل از هم تصویب کرده است. تحریم‌های اتحادیه اروپا همه کشورهای عضو را ملزم به رعایت آن می‌کند و لغو تحریم‌ها از سوی شورای وزیران اتحادیه اروپا با تصویب طرحی در این شورا انجام می‌شود.ضمن اینکه مطابق قواعد ماهوی حقوق بین‌الملل نظیر اصل مصونیت بانک‌های مرکزی، بانک مرکزی در برقراری مبادلات بانکی بین‌المللی آزاد بوده و مستقل از دولت عمل می‌نماید و اعمال تحریم علیه آن، مجاز نمی‌باشد. در این پژوهش به بررسی محتوای انواع آراء و تصمیمات ناشی از تحریم‌های بانک مرکزی جمهوری اسلامی ایران خواهیم پرداخت. در ابتدا برخی از مهم ترین مقررات، تصمیمات و مصوبات شورای اتحادیه اروپا، آراء دیوان دادگستری اروپایی، و آراء کشورهای اروپایی از جمله مصوبات انگلستان  که مرتبط با تحریم بانک مرکزی ایران می‌باشندو در ادامه نیز، به بررسی آراء و تصمیمات ایالات متحده آمریکا که در بخش اول به آراء مرتبط و در بخش دوم به دستورات اجرایی رئیس جمهور، قوانین کنگره و مصوبات خزانه داری پرداخته شده است.</p> https://www.journalspsich.com/index.php/journalspsich/article/download/136/139
